2010-03-15 - Council of State, n. 201858

The wages of religious chaplains and humanist counsellors in prison have to be equal

Key facts of the case - A royal decree has increased salaries of humanist counselors working in prisons to put these wages to the level of humanist counselors working in civil society institutions.

Main reasoning of the Court - This wage increase creates a difference within the prison, between wages of humanist counselors and religious chaplains. The State Council decided that wages have to be equal for the same categorial functions in the prison. The differences between two kinds of humanist counselors are not decisive. The Royal Decree has to be nullified as discriminatory.
